Work & Play Trading Card Company, LLC, (Work & Play) provides its service to you subject to the following Terms and Conditions of Use.

Customer Content

You understand that all images are the sole responsibility of the person from which such Content originated. This means that you, and not Work & Play are entirely responsible for all content that you upload, email or mail to us. You agree to not send, upload, or otherwise transmit any content that contains child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; you agree to not send, upload, or otherwise transmit to us any content that infringes the intellectual property rights or other proprietary rights of any third party.

You certify that you own the rights to use the image(s) being reproduced on your trading card. Any licensing, permission or approval required for use of any information, logos or images is your responsibility.

You further acknowledge and agree that Work & Play may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Work & Play, its users and the public.

On occasion, Work & Play may use a customer image on our website as an example of our work. By agreeing to these Terms & Conditions, you waive your Right of Publicity and grant us permission to use the image in our gallery. (Note: We will not use actual names or information.)

DO NOT mail irreplaceable images or artwork. We will take every precaution to keep your photos or artwork safe, but we cannot guarantee that they will not be damaged in transit. Please make a copy of any photos or artwork that you will submit by standard mail service.

Use & Storage

You acknowledge that Work & Play may establish general practices and limits concerning the maximum number of days that designs or other uploaded content will be retained, as well as the maximum size of any content that may be uploaded. You agree that Work & Play has no responsibility or liability for the deletion or failure to store any content transmitted to us via upload or email. You acknowledge that Work & Play reserves the right to change its general practices and limits at any time, in its sole discretion, with or without notice to you.

Production & Shipping

Work & Play will always act to make sure that production difficulties do not delay delivery schedules. In no case shall Work & Play be liable for any consequence or damages resulting from any delay in shipment or delivery. All Work & Play customers agree not to hold Work & Play liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond Work & Play's direct control. Work & Play shipment and delivery dates are calculated based upon estimates provided by our suppliers. Work & Play will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and/or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation.

Work & Play is not responsible for third-party shipping errors, omissions or damaged shipments. When a package is not delivered due to an error made by the customer in submitting the proper shipping address, Work & Play will reship the package with corrected address and charge an additional shipping fee for the shipment.

Please note that we don't ship to P.O. boxes.

Return Policy

Work & Play offers a 100% satisfaction guarantee on the quality of our custom trading cards.

Customers are 100% responsible for the accuracy of the text submitted for inclusion on trading cards.

Work & Play will refund or reprint all cards, unless mistakes are made by customers.

Shipping charges are not refundable.

Trademark & Copyright

The Work & Play name and logo, and all related product and service names, design marks and slogans, are the trademarks, service marks or registered trademarks of Work & Play.

Indemnity

You agree that you shall indemnify and defend Work & Play and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into products.
